Welcome to Votifo. By creating an account or using the Votifo app or website, you agree to these Terms of Use. Please read them carefully before using our service.
1. About Votifo
Votifo is a social polling platform that allows users to create polls, vote, comment, and view demographic analytics on results. The service is available as a mobile app (iOS and Android) and a web application at votifo.app.
2. Eligibility
You must be at least 16 years old to create an account and use Votifo. By registering, you confirm that you meet this age requirement. If you are under 16, please do not use Votifo.
You must provide accurate information when creating your account. You are responsible for maintaining the security of your account and password.
3. Your Content
You retain ownership of any content you create on Votifo (polls, options, comments, images, videos). By posting content, you grant Votifo a non-exclusive, royalty-free, worldwide licence to store, display, and distribute that content solely for the purpose of operating the service.
You are solely responsible for your content. By posting, you confirm that:

You own the content or have the right to share it
•
The content does not infringe any third-party intellectual property rights
•
The content complies with applicable laws
•
You hold all necessary rights to any music, audio, video, or images you upload — including background music or audio contained within videos. Do not upload media that contains copyrighted music or other material you are not licensed to use.
4. Prohibited Conduct
You agree not to use Votifo to:

Post content that is illegal, harmful, threatening, abusive, harassing, or discriminatory
•
Post content that violates the privacy or personal rights of others
•
Impersonate any person or entity or misrepresent your affiliation
•
Post spam, unsolicited commercial messages, or malicious links
•
Upload malware, viruses, or any code intended to disrupt the service
•
Attempt to gain unauthorised access to accounts, systems, or data
•
Scrape or harvest data from Votifo without our written permission
•
Use Votifo in any way that violates applicable local, national, or international law
5. Content Moderation
We reserve the right to remove any content that violates these Terms or that we determine, at our sole discretion, to be harmful, offensive, or otherwise inappropriate. We may suspend or terminate accounts that repeatedly violate these Terms.
6. Premium Features
Votifo offers optional paid features ("Votifo Premium"). Pricing and included features are displayed within the app. Payments are processed by third-party payment providers. Subscriptions renew automatically unless cancelled before the renewal date. We do not offer refunds for partial subscription periods unless required by applicable law.
7. Intellectual Property
The Votifo name, logo, app design, and all original content created by us are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any Votifo-owned content without our express written permission.
Copyright complaints & takedown
We respect intellectual property rights and respond to valid notices of alleged infringement. If you believe content on Votifo infringes your copyright or trademark, send a notice to copyright@votifo.app including:
•
Identification of the copyrighted work or mark you claim has been infringed
•
The specific poll, comment, or media (with a link) you are reporting
•
A statement that you have a good-faith belief the use is not authorised by the rights holder, the law, or its agent, and that the information in your notice is accurate
You can also report infringing content from within the app using the report button on any poll, comment, or profile (select "Copyright or trademark infringement"). We will review valid notices promptly and remove or disable access to infringing material.
Repeat infringers
We will, in appropriate circumstances, suspend or terminate the accounts of users who are repeat infringers of intellectual property rights.
8. Disclaimers
Votifo is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or secure. Poll results and analytics are provided for informational purposes only and should not be relied upon for professional or commercial decisions.
We are not responsible for the content posted by users. Opinions expressed in polls and comments are those of the individual users and do not reflect the views of Votifo.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Votifo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service or inability to use it, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of Votifo shall not exceed the amount you paid us in the 12 months preceding the claim, or €50, whichever is greater.
10. Termination
You may delete your account at any time from the Profile tab → Settings → Delete Account. Deletion removes your personal data as described in our Privacy Policy.
We may suspend or terminate your account if you breach these Terms, with or without notice. Upon termination, your right to use Votifo ceases immediately.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the European Union and the Kingdom of Spain, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Spain.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via the app or by email at least 14 days before they take effect. Continued use of Votifo after changes take effect constitutes your acceptance of the updated Terms.
